Welcome to www.echo-home.com (the “Site”), the official online store of E.C.H.O. (Egyptian Canadian Home Organization) (“E.C.H.O.,” “we,” “us,” or “our”). These Terms of Service (“Terms”) constitute a legally binding agreement between you and E.C.H.O. governing your access to and use of our Site, including any content, functionality, products, and services offered on or through the Site.
By visiting the Site, purchasing products from us, or otherwise accessing or using any part of the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, Refund and Returns Policy, and Shipping Policy, each of which is expressly incorporated herein by reference. 5. PRODUCTS, PRICING, AND PURCHASES
5.1 Product Information and Availability: We strive to display the colors, images, specifications, and descriptions of our products as accurately as possible. However, we do not guarantee that your device’s display of any color will be accurate, or that product descriptions are entirely error-free. All products are subject to availability. We reserve the right to discontinue any product at any time. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
5.2 Pricing: All prices are listed in Canadian Dollars (CAD) and are subject to change without notice. We reserve the right to correct any pricing errors on the Site, even after an order has been placed. Applicable taxes and shipping costs will be added to your order total during the checkout process.
5.3 Order Acceptance: Your placement of an order constitutes an offer to purchase. All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason at our sole discretion, including but not limited to: product availability, errors in product or pricing information, inaccuracies in your provided information, or suspected fraud. If we cancel an order, we will attempt to notify you and will issue a refund if payment was collected.
5.4 Payment: You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account information, including email address and payment method, so we can complete your transactions and contact you as needed. You represent and warrant that you have the legal right to use any payment method you provide. We use third-party payment processors. All payment information is transmitted securely, and we do not store your complete payment card details on our servers.
6. USER CONDUCT AND PROHIBITED USES

- To attack the Site via a denial-of-service attack or a distributed denial-of-service attack.
- Otherwise attempt to interfere with the proper working of the Site.
7. USER-GENERATED CONTENT
The Site may contain message boards, product review forums, or other interactive features that allow you to submit, post, or upload content (“User Contributions”). You retain ownership of your User Contributions, but by submitting them, you grant E.C.H.O. a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Contributions in any media.
You represent and warrant that you own or control all rights to your User Contributions and that they are accurate, do not violate these Terms, and will not cause injury to any person or entity. We have the right, but not the obligation, to monitor, edit, or remove any User Contributions for any or no reason at our sole discretion. We take no responsibility and assume no liability for any User Contributions posted by you or any third party.
8. DISCLAIMER OF WARRANTIES
YOUR USE OF THE SITE, ITS CONTENT, AND ANY PRODUCTS OR SERVICES OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT, AND ANY PRODUCTS OR SERVICES OBTAINED THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER E.C.H.O. NOR ANY PERSON ASSOCIATED WITH E.C.H.O. MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE OR ITS CONTENTS. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL E.C.H.O., ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SITE, ITS CONTENT, OR ANY PRODUCTS OR SERVICES OBTAINED THROUGH THE SITE.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF ONE HUNDRED CANADIAN DOLLARS (CAD $100) OR THE AMOUNT YOU HAVE PAID TO E.C.H.O. IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless E.C.H.O., its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your User Contributions, any use of the Site’s content or services other than as expressly authorized in these Terms, or your use of any information obtained from the Site.
11. GOVERNING LAW AND JURISDICTION
These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts of the judicial district of Laval, Québec, Canada. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
12. SEVERABILITY
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent possible, and the remaining provisions of these Terms will continue in full force and effect.
13. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund and Returns Policy, and Shipping Policy, constitute the sole and entire agreement between you and E.C.H.O. regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
